Pennsylvania Underage Drinking Law

An individual who is less than 21 years of age and charged with a Non-Traffic Summary Citation under Pennsylvania Crimes Code 6308-Underage Drinking (inclusive of Consumption, Possession or Transportation of Malt/Brewed Beverages) is subject to a license suspension notice under 6310.4- Restriction of Operating Privileges. A conviction, plea of guilty or pre-adjudicated program will result in a Court ordered suspension notice forwarded directly to the Pennsylvania Department of Transportation. The length of a suspension is as follows:

a) First Offense - 90 days
b) Second Offense - 1 year
c) Third Offense and any offense thereafter - 2 years


If your son or daughter has been cited under 6308 contact Mr. List immediately. There are possible defenses and often alternative programs that can avoid these penalties.
